Can i travel on b1b2 visa and Marry a USA Citizen
CAN YOU ?…yes you can. SHOULD YOU ?…No you should not.
So, love is something that is not pre-arranged it can happen at at any time and you can be anywhere when it happens. And therefore i believe US government has not yet closed this loop hole of traveling on B1B2 Visa and then changing status to Marriage or Green card.
However when you do this pre-planned, following are the rules that you are breaking/bending etc:
1. Your USA b1b2 visa was given for the purpose of tourism and business. Therefore at point of entry you will mention the purpose of your visit as either business or pleasure. When you have pre -planned to get married in USA ideally that is the reason you should be giving. (well if you say that, they are not going to give you the entry !)..Therefore you are effectively lying to Point of Entry Officer.
2. When you go for your green card interview… everyone who changes status to GC based on marriage has to go through it at one point or the other. The USCIS officer will clearly see through this and will automatically start scrutinizing your case more than required.
Well, in my best knowledge most of these cases are approved as long as the marriage is for real. But incase if there is a rejection. you are required to travel back to your country and your spouse is asked to file for immigration papers for you and follow the procedure, which in 2013 was taking approximately 8-12 months !!
There are other simpler ways, like K1 Visa (Fiancee Visa) which will allow you to travel much earlier without having to lie to point of entry officer. AVS strongly suggests to use legal means for travel to USA.
